were present:

who welcomed everyone in attendance.
2 Invocation and Pledge of Allegiance – John B. Roberts, Sr. Mr. John Roberts gave the Invocation and led in the Pledge of Allegiance . 3 Approval of Agenda Chairman Derting called attention to communication received from John A.
Martin, Attorney, counsel for Mr. & Mrs. Melvin Smeltzer, and his request that the
special use permit application be tabled until the next available meeting.
On motion of Mr. Barker, second by Mr. Roberts, it was resolved to approve the Agenda with the
following amendments:
Add: 17.d Transfer from Reserves for Contingency, Community Economic Development -
$5,000; Abingdon/WC Sewer - $8,754.43;
Delete: 7. Presentation of Report from Mount Rogers Partnership/Peaks of Virginia (Jerry

6/13/2000 9743 Continuance to July 11, 2000; 6.a Melvin and Beverly Smeltzer: Request for a Special Use Permit to construct and
operate a small business in general, more specifically, a 24’ x 30’ kennel for
boarding of pets on property located off of State Route 58 onto Penn Road in the
Templin Subdivision in an A-2 (Agricultural, General) zone, Tyler Magisterial
District
The vote on this motion was as follows: (6-0) Mr. Derting Aye Mr. Roberts Aye Mr. McCall Aye Mr. Ingle Aye Mr. Rector Aye Mr. Barker Aye 4 Approval of Minutes: a. Regular Meeting of May 23, 2000 On motion of Mr. Barker, second by Mr. Ingle, it was resolved to table action on
the Minutes of May 23, 2000 with corrections as noted until June 27, 2000.

Dog Damage Claims The following action was taken on Dog Damage Claims: (Mr. Barker left the meeting room for a brief period.) a. Norman Roberts, $160.00 Mr. Norman Roberts appeared before the Supervisors to explain the claim he
submitted and to respond to questions from the Board. In his comments, Mr.
Roberts stated the claim should be for $180.00 and that amount would represent his
purchase cost.
Ms. Bright pointed out that Extension Service establishes the fair market value for live stock and
they determined the amount of $160.00. Additionally, Ms. Bright explained to the Supervisors that
the owner of the dog that killed the goats could not be identified.
On motion of Mr. Ingle, second by Mr. Roberts, it was resolved to approve Dog Damage Claim in
the amount of $160.00 filed by Norman Roberts for goats killed by unidentified dog.

Robert G. Johnson, $750.00 Mr. Robert Johnson appeared before the Supervisors to respond to questions from
the Board.
On motion of Mr. Roberts, second by Mr. Rector, it was resolved to approve Dog Damage Claim
in the amount of $750.00 filed by Robert Johnson for sheep killed by a dog.
The vote on this motion was as follows: (5-0) Mr. Derting Aye Mr. Roberts Aye Mr. McCall Aye Mr. Ingle Aye Mr. Rector Aye (Mr. Barker returned to the Board table.) 6 Planning & Zoning Public Hearings Request for Special Use Permit: a. Melvin and Beverly Smeltzer: Request for a Special Use Permit to construct and operate a small business in general, more specifically, a 24’ x 30’ kennel for boarding of pets on property located off of State Route 58 onto Penn Road in the Templin Subdivision in an A-2 (Agricultural, General) zone, Tyler Magisterial District. Received communication from Mr. John A. Martin, Counsel for Mr. & Mrs. Melvin Smeltzer, “requesting that the special use permit application be tabled until the Board’s next available meeting.” Upon discussion of the request, action was taken to continue the public hearing to Tuesday, July 11, 2000. ***** b. Earnest Emmett Poe: Request for a Special Use Permit to construct and operate a recreational vehicle park and campground containing 150 units on property located on the South side of State Route 664 near the intersection of State Route 664/663 in an SR (Shoreland Recreation) zone, Madison Magisterial District. Mr. Derting opened the public hearing and invited comments both in support of and in opposition to application by Earnest Emmett Poe for a Special Use Permit to construct and operate a recreational vehicle park and campground containing 150 units on property located in a SR (Shoreland Recreation) zone, Madison Magisterial District. Messrs. Sage and Joe Johnson, representing Earnest Emmett Poe, appeared before the Board of Supervisors in support of the special use permit. Mr. Sage Johnson opened his comments explaining Mr. Poe’s property as being in a shoreline recreation zone and that he has 15.2 acres on which to construct a campground. Reading from the Washington County Code, he pointed to the differences between Shoreline Recreation and Conservation Recreation zoning, and stated his view that it was the Board’s intent to have some development in the Shoreline Recreation district. 6/13/2000 9745 Mr. Sage Johnson referred to a site map prepared by Bob Taylor, and distributed several photographs of the property. He stated that at the Planning Commission meeting there was opposition expressed for the reason that a campground development would interfere with a view of the Lake. He referred to the pictures and stated no view would be cut off. Mr. Johnson commented on correspondence he has received from Doug Canady, Washington County Service Authority, stating that water pressure is adequate for a campground without degrading the services of the remainder of the area. He explained Mr. Poe would develop 150 sites with room for two parking spots at each site. There will be security provided at the campground, he stated, with a restriction on noise from 10:00 p.m. to 6:00 p.m. Mr. Bob Taylor, R & D Designs, was present and responded to questions from the Board. He described the proposed sites as having a view of the lake with sufficient space for two parked vehicles. He stated the layout provides for a retention pond, a connection to the existing 4” waterline, a package sewage plant with secondary treatment, underground electric service, and the entire area will have screening. Mr. Earnest Poe was present and responded to questions from the Board assuring them he will operate the campground within the guidelines of the County ordinance. He stated the campground will be operational eight months and closed for four months. Discussion ensued relative to whether camping vehicles could be set up permanently and related restrictions of the County ordinance that refers to occupancy of camping vehicles. Ms. Freeman, Zoning & Subdivision Official, clarified that the ordinance does not require the camping vehicle to be moved after 90 days, but it limits the occupancy to no more than 90 consecutive days. Patrick Mannix raised the question of how the ordinance would be enforced. William Ford, adjacent property owner on the west side, stated his opposition to the proposed campground expressing concerns over increased traffic, narrow road and road design, view obstruction of the Lake and shoreline, and abundance of campgrounds at the Lake. Keith and Denise Edwards, adjacent property owners, addressed the Supervisors. Mrs. Edwards explained they are summer residents and share the lakeside with Mr. Poe. She stated her family uses the Lake for recreation and the children use the Cove between properties. She expressed her concern about sewage being dumped into the Cove where her children play, and opposition to transience of campers, cove traffic, devaluation of their property, and excessive noise that would come from the proposed campground,. Boyd Poe, adjoining property owner, stated his opposition to a campground development based on devaluation of his property. He stated that in 1986 the Board of Supervisors took the position of not approving additional campgrounds in the area. He requested that the Supervisors support the previous Board’s position. Roger Poe, neighboring property owner, stated his opposition to a campground development expressing concern that there would be increased road traffic, transient campers and campers becoming permanent residents, excessive noise and devaluation of property. Dean Daniels, neighboring property owner, expressed his opposition to the proposed campground. He stated he can see Lakeshore Campground and Wolf Lair Campground from his house. He claims the campers discharge sewage when they leave the camp site and leave trash. Mr. Daniels expressed his preference that a housing development be considered rather than a campground. Louise Bowden, Campground Director, United Company Camp Sequoya, expressed opposition to the proposed campground. She described Camp Sequoya property as joining the Cove and stated that she tries to keep their campers out of the Cove because it is small. She stated the road is narrow, the water pressure is poor in the summer time, and with the proposed campground development there, the traffic would increase. She stated Camp Sequoya is concerned about 6/13/2000 9746 property devaluation. Ms. Bowden reported the shoreline is cleaned of litter constantly and is concerned if a campground is developed, it will cause an increase in the litter problem. Joe Johnson addressed the Supervisors explaining the property is zoned for recreation and the County ordinance will not allow for a housing development. He argued that Mr. Poe has brought a plan to the Supervisors for a proposed campground that will be policed, water pressure will be adequate, and it will be attractive. In response to public comment, he pointed out that some people will oppose a campground development, however, he stated the County ordinance permits it and does not permit a housing development. He continued, no property will be devalued there. He emphasized that regulations have been placed on Mr. Poe in order for him to enjoy his property. He stated he owns a home, beautiful land, and wants to use it. There being no further comments, Mr. Derting declared the public hearing closed. In response to Mr. Johnson’s statements, Ms. Bright pointed out that the County ordinance allows building of single family residential dwellings on land in the Shoreland Recreation District. Mr. Ingle read to the other members of the Board the statement of intent for the Shoreland Recreation Zoning District. He stated his interpretation that the emphasis was on low-density development and that construction of a campground would be contrary to the intent of the Shoreland Zoning District. He also made notes of comments made by speakers opposed to the proposal. On motion of Mr. Ingle, second by Mr. McCall, it was resolved to follow the recommendation of the Planning Commission and deny request of Earnest Emmett Poe for a Special Use Permit to construct and operate a recreational vehicle park and campground containing 150 units on property located on the South side of State Route 664 near the intersection of State Route 664/663 in an SR (Shoreland Recreation) zone, Madison Magisterial District. The vote on this motion was as follows: (4-2) Mr. Derting Aye Mr. Roberts Aye Mr. Ingle Aye Mr. McCall Aye Mr. Rector Nay Mr. Barker Nay Mr. McCall stated that he supports the motion because of the statement of intent of the zoning
ordinance as read by Mr. Ingle.

Constellation Power/Wolf Hills Energy Project
Ms. Christianne E. Parker, Assistant County Administrator, addressed the
Supervisors requesting they authorize expenses associated with the Sewer
Connection for Constellation Power.
6/13/2000 9747 On motion of Mr. Ingle, second by Mr. Barker, it was resolved to appropriate up to $35,000 from
Reserves for Contingency to Bristol Virginia Utilities Board for relocation of existing sewer lines
and additions for Constellation Power to connect to the system.

attend a DAR social and fundraiser.
a. Planning Commission Compensation Ms. Bright provided a written response to the Board of Supervisors question
concerning statutory limits on compensation for members of the Planning
Commission. She stated there are no monetary limits set by either the Code of
Virginia or the Washington County Code for compensation to be paid to members of the local
Planning Commission.
There was consensus agreement to schedule the matter of compensation for Planning Commission
members for the July 11, 2000 meeting of the Board of Supervisors.

Tax Issues Ms. Bright provided a response to the Board of Supervisors questions concerning
an increase in tax to fund the E-911 program, and the possible implementation of a
meal tax ordinance.
Ms. Bright reported to increase the tax for E-911 program, it would involve an amendment to the
County Code Ordinance which requires a public hearing 120 days prior to enactment.
Concerning a meal tax ordinance, Ms. Bright stated it would require a vote by referendum before it
could be put into place in Washington County. Ms. Bright provided a sample meals tax ordinance
for the Supervisors to review.
A brief discussion ensued on the consumer use tax. 17 Consent Agenda On motion of Mr. Rector, second by Mr. Barker, it was resolved to approve the
following Consent Agenda Items:
a. Supplemental Appropriation, Washington County School Board, $140,577 b. Payment of Bills, May 10, 2000 c. Community & Economic Development - $ 5,000.00 :: Abingdon/WC Sewer - $ 8,754.43 6/13/2000 9753 The vote on this motion was as follows: (6-0) Mr. Derting Aye Mr. Roberts Aye Mr. McCall Aye Mr. Ingle Aye Mr. Rector Aye Mr. Barker Aye Mr. Barker filed a disclaimer disclosing he has a personal interest in certain aspects of the Washington County Budget related to appropriations to the Washington County School Board; that he is an employee of the Washington County School Board and appropriations to the Board could indirectly affect his position, salary, employment benefits, etc.; that he is a member of a group of employees which is affected by the amount of the appropriation to the Washington County School Board; and, that he can participate in this transaction fairly, objectively and in the public interest. 18 Board Member Reports Concerning construction of Route 58, Mr. Roberts reported there is a group from
Damascus that is working on a proposal to request Virginia Department of
Transportation officials to protect a stretch of local forest when improvements are
made to US Highway 58. He stated the group may appear before the Board requesting support of a
resolution.
Mr. Derting commended Ms. Christianne Parker for her strong accomplishments in promoting
economic/community development in Washington County.
19 Citizen Comments At this time, Chairman Derting asked Mr. Roberts to read the rules for citizen
comments, and invited comments from citizens on items that do not appear on the
Agenda.
Lacy Love addressed the Supervisors concerning the position of County Planner. Mr. Derting
responded the position is under consideration particularly because the County is considering a
comprehensive development plan.
Patrick Mannix commented on the topics of Mendota Trail, Sheriff’s Office personnel, salary
increases for School Board officials, Constellation Power.
20 Adjournment On motion of Mr. Barker, second by Mr. Rector, it was resolved to adjourn the
meeting.
